Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Entrepreneur: the natural or legal person who offers products remotely to consumers;

Consumer: the natural person who does not act in the exercise of a profession or business and who enters into an agreement with the entrepreneur;

Distance Agreement: an agreement concluded in the context of an organized system for remote sale of products, whereby one or more techniques for remote communication are used up to and including the conclusion of the agreement;

Reflection Period: the period during which the consumer can make use of the right of withdrawal;

Right of Withdrawal: the consumer’s option to withdraw from the distance agreement within the reflection period.

Article 3 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance agreement concluded between entrepreneur and consumer.
Before the agreement is concluded, the text of these terms and conditions will be made available to the consumer.
If specific product or service conditions apply in addition to these general terms and conditions, in case of conflict the provision most favorable to the consumer shall prevail.
Article 4 – The Offer
The offer contains a complete and accurate description of the products offered.
Images are a truthful representation of the products offered, although handmade or living products (such as plants) may show slight variations.
Obvious errors or mistakes in the offer do not bind the entrepreneur.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the stated conditions.
If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of acceptance electronically.
Article 6 – Right of Withdrawal
The consumer may dissolve an agreement regarding the purchase of non-living products within 14 calendar days without giving any reason.
The withdrawal period starts the day after the consumer or a third party designated by the consumer receives the product.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the costs of returning the product will be borne by the consumer.
If the consumer has already paid an amount, the entrepreneur will refund this as soon as possible, but no later than 14 days after receiving the returned product.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal is excluded for products that spoil quickly or have a limited shelf life, such as plants and plant cuttings.
This exclusion is clearly stated in the offer.
Article 9 – The Price
The prices stated for products include VAT and exclude shipping costs, unless otherwise stated.
Shipping costs will be clearly indicated during the ordering process.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products comply with the agreement and the specifications in the offer.
Any warranty is limited to what is offered by the manufacturer or supplier.
Article 11 – Delivery and Execution
The entrepreneur will exercise the greatest possible care when processing orders and assessing requests for delivery.
Delivery takes place at the address provided by the consumer.
Estimated delivery times:

The Netherlands: 1–3 working days (package), 1–3 working days (mailbox)

Belgium: 1–5 working days

Germany: 1–5 working days
Exceeding the delivery period does not entitle the consumer to compensation.
Article 12 – Duration Transactions: Duration, Termination, and Extension
Not applicable, as [Company Name] does not offer subscriptions or ongoing agreements.
Article 13 – Payment
Unless agreed otherwise, amounts owed by the consumer must be paid immediately when placing the order.
Payment is safely possible via the following methods:

All payments are processed via a secure payment environment.
The consumer is obliged to immediately report any inaccuracies in the provided payment details to the entrepreneur.
Article 14 – Complaints Procedure
Complaints about the execution of the agreement must be submitted fully and clearly described within a reasonable time via [email address].
The entrepreneur will respond to the complaint substantively within 14 days.
If a complaint cannot be resolved amicably, a dispute arises that is subject to the dispute resolution procedure.
Article 15 – Disputes
Dutch law exclusively applies to agreements between the entrepreneur and the consumer to which these terms and conditions relate.
Disputes will preferably be resolved amicably. If this is not possible, the dispute may be submitted to the competent court in the Netherlands.
Article 16 – Additional or Deviating Provisions
Additional provisions or deviations from these terms and conditions may not be to the detriment of the consumer and must be recorded in writing.
